TERMS & CONDITIONS

This website (the “Site”) is operated by T & K Suppressors, a division of T & K Hunting Gear LLC(“we,” “us,” or “our”). By accessing the Site, placing an order, or using any of our services, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, do not use the Site.

1. Acceptance of Terms & Eligibility

These Terms apply to all users of the Site, including browsers, customers, and contributors of content. By using this Site, you represent that you have the legal capacity to enter into these Terms.

Age Requirement:
You must be at least 21 years of age, or the age of majority in your state of residence (whichever is greater). You agree not to use this Site or purchase products for any unlawful purpose or in violation of any federal, state, or local firearm laws.

2. Changes to Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Site constitutes acceptance of the revised Terms.

3. Products & Services

We offer suppressors and firearm-related accessories. Certain products are regulated under the National Firearms Act (NFA) and other federal, state, and local laws.

Product Availability & Accuracy

  • Products may be limited in quantity or availability.

  • We reserve the right to modify or discontinue any product at any time without notice.

  • Product images, colors, finishes, and specifications may vary due to manufacturing tolerances or display differences.

Pricing

  • Prices are subject to change without notice.

  • We reserve the right to correct pricing errors and cancel orders affected by such errors.

4. Ordering, Billing & Shipping

You agree to provide current, complete, and accurate billing, shipping, and contact information for all purchases.

Regulated Products & Shipping

  • Suppressors ship only to a valid FFL/SOT dealer.

  • The customer is solely responsible for selecting an eligible dealer.

  • Dealer transfer fees, storage fees, and local charges are not included in our pricing.

  • Suppressor orders will not ship until all legal requirements are satisfied, including ATF approval and payment of applicable taxes.

  • ATF processing times and regulatory delays are outside of our control.

Order Refusal

We reserve the right to refuse, limit, or cancel any order for reasons including compliance concerns, suspected fraud, or errors in product or pricing information.

5. Returns, Refunds & Cancellations

Suppressors (NFA Items)

  • All suppressor sales are final and non-returnable.

  • Once ATF paperwork (Form 3 or Form 4) has been submitted, suppressor orders cannot be canceled.

Accessories

  • Unused accessories may be returned within 30 days of delivery.

  • Return shipping costs are the responsibility of the customer.

  • All returns are subject to inspection and approval.

ATF Denials or Return Without Action (RWA)

If an ATF application is denied or returned without action:

  • Refunds may be issued for the product price minus any non-recoverable costs, including but not limited to administrative, compliance, shipping, or transfer fees.

  • Refunds are processed only after the suppressor is legally returned to our possession.

  • ATF decisions are outside of our control, and we assume no liability for such outcomes.

6. Legal Compliance

You are solely responsible for ensuring the legality of purchasing, possessing, and using our products in your jurisdiction.

We are not responsible for changes in law, ATF policy, regulatory interpretation, processing delays, or enforcement actions.

7. Payment Disputes & Chargebacks

Initiating a chargeback or payment dispute while an ATF transfer is in progress constitutes a breach of these Terms. We reserve the right to suspend service, cancel orders, and recover associated administrative, legal, and compliance costs.

8. Privacy & Data Security

Your use of the Site and submission of personal information is governed by our Privacy Policy. While we use secure, encrypted payment processors, no system or transmission method can be guaranteed as completely secure.

9. Third-Party Services & Links

The Site may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of any third-party sites. Accessing third-party services is at your own risk.

10. User Content & Submissions

Any feedback, reviews, comments, or other submissions you provide may be used by us for lawful business purposes without compensation. You represent that all submissions are lawful, accurate, and do not infringe on the rights of any third party.

11. Warranty & Limitation of Liability

Lifetime Warranty

We offer a Lifetime Warranty covering manufacturing defects under normal, lawful use. This warranty does not cover damage resulting from misuse, improper installation, modification, illegal use, incompatible hosts or ammunition, or excessive heat beyond intended use.

Disclaimer of Warranties

Except as expressly stated in writing, all products and services are provided “as is” and “as available,” without implied warranties of merchantability or fitness for a particular purpose.

Limitation of Liability

To the fullest extent permitted by law, our total liability shall not exceed the amount paid for the product giving rise to the claim.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of South Dakota, without regard to conflict-of-law principles.

13. Termination

We may suspend or terminate access to the Site or services at any time for violations of these Terms or applicable law. Obligations incurred prior to termination shall survive.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Indemnification

You agree to indemnify and hold harmless T & K Suppressors and T & K Hunting Gear LLC, including their owners, employees, contractors, and affiliates, from any claims, damages, losses, liabilities, or expenses arising from misuse, unlawful use, or violation of these Terms.

16. Gun Trusts

If you use a gun trust or other legal entity to purchase NFA-regulated products, you are solely responsible for the validity and legality of that trust or entity. We do not provide legal advice and recommend consulting a qualified firearms attorney.

17. Wholesale & Bulk Orders

Wholesale, bulk, or resale purchases may be subject to separate terms and agreements. Please contact us directly for wholesale inquiries.
